Nintendo fights $232 million EU penalty

Nintendo is fighting a EUR 149.1 million (USD 232 million) fine levied against it by EU regulators for price fixing. According to a Bloomberg report, the company contends that the calculation of the fine was irrational and discriminatory. "The penalty was unfair, illegal, even shocking," Ian Forrester, representing Nintendo, told the European Court of First Instance in Luxembourg.

“Japanese stocks fell the most in a month on concern fallout from the U.S. mortgage market crisis is spreading to Japan’s consumer lenders and a U.S. recession will extend the dollar’s decline against the yen. Nintendo, which sells more than twice as many Wii game machines in the Americas as in Japan, lost 5.8 percent to 50,200 yen in Osaka trading.”

Responding to criticism that the Nintendo's E3 showings lacked a major first-party Wii title aimed at the hardcore gamer, president Satoru Iwata has apologized to those who felt betrayed. "We are sorry about [the E3] media briefings, specifically for those who were expecting to see Nintendo show something about Super Mario or Legend of Zelda," Nintendo president Satoru Iwata told Forbes.

Microsoft recently drop royalties paid for Xbox Live Arcade from 70 % to 35 % on games < $4m in revenues (the rate rises closer to 50 % when revenues > $4m). ,,, "Nintendo explained that we'll not only be making a better royalty rate from WiiWare games, but we'll also have a better chance of selling games, since the service won't be clogged up with the retro titles that have blighted the chances of many independent studios on Xbox Live Arcade," said one studio business development boss.

Japanese Game Makers: Nintendo, I can't quit you!

According to a Japanese Nikkei newspaper survey, fiscal 2007 will see a serious shift in focus for these big game developers. Namco Bandai is planning to up its count of Nintendo titles 109% to 115, and Sega looks to follow suit, bumping up their Nintendo shipments 96% to 49 titles. Capcom is also sending the Nintendo love, adding 5% more titles to ship 20 next year. The total shipment of Nintendo titles in fiscal 2007 will total 26.88 million, so there will be no bitching about a 'lack of good Wii games'. Meanwhile, all three of these major game companies plan to cut the number of shipments for Sony's consoles (PS3 and PSP) by 30%-40% in the same time frame. Ouch -- sorry Sony.
