EB Games held conference calls for its Canadian stores informing them of the new policy changes and revealing alarming failure rates of the Xbox 360. "The real numbers were between 30 to 33 percent," said former EB Games employee Matthieu G., adding that failure rate was even greater for launch consoles. "We had 35 Xbox 360s at launch I know more than half of them broke within the first six months (red lights or making circles under the game discs). Two of them were dead on arrival."

Bright lawyer’s Xbox dies after 13months, He phones Microsoft and they charge him $130+ for a repair… Bright lawyer isn’t too happy, starts doing some research, he realizes there is a pretty big problem out there with the Xbox360 and starts up some kind of lawsuit…
He could argue that Microsoft have known about the defective Xbox360 hardware since shortly after launch and haven’t done enough to solve this issue, effectively Microsoft have been knowingly selling defective goods to the public for 18+ months. Next bolt on some extra dirty lawyer tricks, lets say… Bright Lawyer spent $250 on Xbox360 games, and a further $100 on Xbox Live Arcade games – This money is wasted unless he pays Microsoft another $130 to get his Xbox repaired… He could argue that Microsoft have been scamming the public, get them addicted to the games (we all know games are addictive right?) and then milk them for more money to get their defective console repaired so they can play them… Next, lets call in the witnesses from retailers around the world with hard figures of the failure rates, throw in a few hundred annoyed customers who feel they have been cheated having to pay $130 for their console repair and BINGO Microsoft are really in trouble.
Microsoft could have some serious problems on their hands, there might even be a forced recall of ALL Xbox360’s. There is evidence of reconditioned Xbox units having new heat syncs installed to try and fix the problem, why haven’t these heat syncs been installed as standard on all new manufactured units? Further evidence that Microsoft knows there is a design fault with the Xbox360, but they have failed to address the issue and continued selling faulty consoles to the public.
The bottom line is, if you buy a games console, you expect it to last for ~5years. No other console has suffered mass hardware failure on this scale EVER. In the past when Sony had problems with the CD drives in the PS1, they quickly resolved the issue, and they certainly didn’t demand $130 for the repair.
Wake up Microsoft! The Xbox brand is already suffering because of this issue.
