The games in these bundles are not free. The article says they're priced at 269 Euros, which is higher than normal. I think only the Lego Indy/Panda bundle has free games.
Apart from that, I can't see that scenario you mentioned actually happening. If people can't find a specific bundle they'll just buy a different one and get the game separately. IIRC, DS's bundles are all limited edition bundles, so it is not the same as these 9 X360's bundles (which is unlimited supplies). The only unlimited DS bundle I remember is the Brain Age 2 bundle, and no other come to mind.

The main attractiveness of X360 bundles is FREE game. I am not sure that someone who are, say, wanted GoW2 bundle, are willing to buy, say Kungfu panda & Indiana Jones bundle, and spend more money buying separate GoW2 game. At least, that is what I would do in the above mentioned scenario.
You are right that DS colour can't be changed, but in my experience, if someone wanted a color that is not availalbe, he sometimes (not always) settle for another color. Usually it is female that is more "color specific", and would go to different stores to find the right color (usually pink DSL), and will delay purchase if they couldn't find the right color. Interesting that France and Germany aren't getting it as they are big footballing countries, not sure what PES sales are like there but i'd expect them to be reasonably high.

I do think that its a problem for smaller retailers having so many bundles, although larger ones should be relatively unaffected. Also i dont think it's too much of a consumer headache, the DS has tons of bundles and look how well thats selling. I don't think too much choice will be an issue. It's not like all the bundles are coming at once, they're spread out a bit. And it's not clear if all countries will get all nine bundles. From Kotaku's article about the Pro Ev bundle:
"The bundle will be available in Austria, Greece, Hungary, Italy, Netherlands, Portugal, Spain, and the UK."

Me thinks, it is retailer's nightmare, and consumer headache. There is such thing as "too many options / choice"
If I want a certain bundle, and it is not available in my usual shop, I either have to hunt it down (headache) or settle for another "less perfect bundle for me".

I think it is very interesting in the UK at the moment in the battle of the soccer games which generally are some of the biggest sellers of the year. Sony are backing Fifa 09 in their adverts with PS3 footage and logos shown; where as Microsoft are backing PES09 with 360 footage being shown in the adverts etc. and this new bundle.
It signifies the demographic in the UK that the consoles are targeted at rather well i feel. Fifa is aimed at a younger more casual gamer with its simpler gameplay and reliance on official licensing, which i feel is the same as PS3. Where as PES is aimed at the more serious/ hardcore gamer with its lack of licensing (which deters the casual 'football fan') but better gameplay, just like i think the 360 is.

Is it Indiana Jones/Kungfu Panda (or package, choose only one) or Indiana Jones & Kungfu Panda (and package, get both, not just one) ?
